OFFICIAL RULES

  1. METHOD OF ENTRY: Limit one photo per person per day. Must be at least 18 years of age. Photos are void if altered, transferred, purchased, sold, or prohibited by law. Photos have no cash value. Photo entries begin at 12:01 a.m. Pacific Standard Time (“PST”) on June 1, 2026, and end at 11:59 a.m. PST on June 30, 2026. Lummi Bay Market's computers shall be the official clock for purposes of calculating the beginning and end of the photo entry period. All entries become the property of Lummi Bay Market and may not be acknowledged or returned. By participating, entrants agree to be bound by these Official Rules and the decisions of Lummi Bay Market, which are binding and final on matters relating to this contest.

  2. DRAWING & WINNER NOTIFICATION: Potential winner(s) will be selected in a random drawing on or about July 1 from all eligible entries received. Odds of winning depend on the number of eligible entries received. Potential winners will be notified by email and may be required to execute and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release, within three (3) days of the date of issuance. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, the potential winner is not in compliance with these Official Rules, or Lummi Bay Market is unable to reach a potential winner within a reasonable time period, the prize will be forfeited and, at Lummi Bay Market’s discretion, an alternate winner will be selected.

  3. PRIZES: Winner solely responsible for all expenses, costs, and/or fees associated with acceptance and/or use of the prize not specified herein as being awarded, including, without limitation, any and all taxes. Lummi Bay Market is not responsible for any injury or harm to the winner(s) after the prize has been awarded. Winner may not substitute, assign, or transfer prize, but Lummi Bay Market reserves the right, at their sole discretion, to substitute a prize with one of comparable or greater value. The prize is awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Lummi Bay Market’s sole discretion. Limit one (1) prize per photo and one (1) prize per LBM Rewards Membership.

  4. GENERAL CONDITIONS: Lummi Bay Market, as the released party, is not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries or photos; or other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with administration of the raffle, processing of entries, contacting the potential winners, announcement of prizes, or in any contest-related materials. Lummi Bay Market is also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the contest. Persons who tamper with or abuse any aspect of the contest or who are in violation of these Official Rules, as solely determined by Lummi Bay Market, may be disqualified and all associated entries will be void. Should any portion of the contest be, in Lummi Bay Market’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of Lummi Bay Market, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Lummi Bay Market reserve the right at their sole discretion to suspend, modify or terminate the contest and, if terminated, at their discretion, select the potential winners from all eligible, non-suspect entries received before action taken. Entrants, by participating, agree that Lummi Bay Market, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Lummi Bay Market”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind, including death or damage to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this raffle. Each entrant, by submitting an entry, except where legally prohibited, grants permission for Lummi Bay Market and their respective designees to use his/her name, photograph, and/or other likeness and prize information for advertising, trade, and promotional purposes, without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice, review, or approval. In the event of a dispute regarding entries received from multiple users having the same Instagram and or Facebook account, the authorized subscriber of the account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. An authorized account subscriber is a natural person who is assigned the Instagram account by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning accounts. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein.

  5. CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this contest, participant agrees that any disputes and causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually, within the Lummi Nation Tribal Court. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this raffle), and participant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant and Lummi Bay Market in connection with the sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the Lummi Nation Tribal Court.
